As the HIV epidemic continues to grow worldwide, women are increasingly and disproportionally affected. With the introduction of anti-retroviral medications that have been found to effectively prevent perinatal transmission of HIV, the approach to HIV testing in pregnant women has grown increasingly more controversial. In recent years, the model of voluntary counseling and testing (VCT) has come into question with opt-out testing now advocated for by the Centers for Disease Control and occurring widely in pregnancy. The benefits of opt-out testing (...) are numerous and may justify its use in replacing the VCT that many have come to see as insufficient. An ethical analysis of opt-out testing suggests it may be at odds with true informed consent and involve a degree of coercion that would not be allowed outside the prenatal setting. If opt-out testing is going to remain the standard of care then the ethical issues it raises must be made transparent. Strategies need to be designed for ensuring that HIV counseling and testing in pregnancy is done in accordance with ethical and reproductive rights principles. (shrink)

The major competing statistical paradigms share a common remarkable but unremarked thread: in many of their inferential applications, different probability interpretations are combined. How this plays out in different theories of inference depends on the type of question asked. We distinguish four question types: confirmation, evidence, decision, and prediction. We show that Bayesian confirmation theory mixes what are intuitively “subjective” and “objective” interpretations of probability, whereas the likelihood-based account of evidence melds three conceptions of what constitutes an “objective” probability.

THE CENTRALITY OF "SYMPATHY" to Adam Smith's Theory of Moral Sentiments points to the centrality of love in the book. While Smith delineates a somewhat unusual, technical sense of "sympathy", his actual use of the term frequently slips into its more ordinary sense of "compassion" or affectionate fellow feeling. This no doubt intentional equivocation on Smith's part helps suffuse the book with these themes, to the point that, without much exaggeration, one could say that the Theory of Moral Sentiments is (...) generally about love: our need for love and sympathy, love as friendship, self-love, the love of praise and praiseworthiness, the love of beauty. Even in the Wealth of Nations, our loves are thought to be very important in explaining our behavior. Smith is unusual among modern moral philosophers in according so central a place to love in this broad sense, although of course Christianity made love a central theme in reflection on ethical life, and philosophers such as Hutcheson made benevolence a key virtue in their ethical systems. However, it is not our purpose to examine Smith's critique of Hutcheson or indeed of any of his predecessors. Rather we aim in this paper to reflect on his treatment of this topic. We shall do so in part by means of comparisons with Aristotle and Plato, first with respect to friendship and then with respect to love generally. Smith's writing is replete with classical references, raising the issue of the degree to which his thought is "ancient" or "modern." Friendship is arguably the pinnacle of social relations for the ancients, and thus it provides us with a useful device for determining the degree to which Smith's thought embodies classical moral and philosophical principles. The subtlety of Smith's interweaving of traditions will become visible as we reflect not just on the ways Smith's thought exhibits classical conceptions of friendship and love, but also on the ways he departs from them. For in at least one important respect, love is a closed book from Smith's standpoint, and thus, as it turns out, also at odds with classical friendship. (shrink)

High stress despite low tidal volumes may worsen lung injury and increase risk of death. No widely available parameter exists to assess global lung stress. We aimed to determine whether the volume delivered during a recruitment maneuver is inversely associated with lung stress and mortality in acute respiratory distress syndrome. Design: Substudy of an acute respiratory distress (...) syndrome clinical trial on esophageal pressure-guided positive end-expiratory pressure titration. Setting: U.S. academic medical center. Patients: Forty-two patients with acute respiratory distress syndrome in whom airflow, airway pressure, and esophageal pressure were recorded during the recruitment maneuver. Interventions: A single recruitment maneuver was performed before initiating protocol-directed ventilator management. Recruitment maneuvers consisted of a 30-second breath hold at 40 cm H2O airway pressure under heavy sedation or paralysis. VRM was calculated by integrating the flow-time waveform during the maneuver. End-inspiratory stress was defined as the transpulmonary pressure during end-inspiratory pause of a tidal breath and tidal stress as the transpulmonary pressure difference between end-inspiratory and end-expiratory pauses. Measurements and Main Results: VRM ranged between 7.4 and 34.7 mL/kg predicted body weight. Lower VRM predicted high end-inspiratory and tidal lung stress. After adjusting for Pao2/Fio2 and either driving pressure, tidal volume, or plateau pressure and positive end-expiratory pressure, VRM remained independently associated with both end-inspiratory and tidal stress. In unadjusted analysis, low VRM predicted increased risk of death. VRM remained significantly associated with mortality after adjusting for study arm. Conclusions: Low VRM independently predicts high lung stress and may predict risk of death in patients with acute respiratory distress syndrome. (shrink)

How did the events of the early modern period affect the way gender and the self were represented? This collection of essays attempts to respond to this question by analysing a wide spectrum of cultural concerns - humanism, technology, science, law, anatomy, literacy, domesticity, colonialism, erotic practices, and the theatre - in order to delineate the history of subjectivity and its relationship with the postmodern fragmented subject. The scope of this analysis expands the terrain explored by feminist theory, while its (...) feminist focus reveals that the subject is always gendered - although the terms in which gender is conceived and represented change across history. Feminist Readings of Early Modern Culture not only explores the representation of gendered subjects, but in its commitment to balancing the productive tensions of methodological diversity, also speaks to contemporary challenges facing feminism. Over the last decade, numerous interventions and techniques that aim to engender, strengthen, and expand compassion have been created, proliferating an evidence base for the benefits of compassion meditation training. However, to date, little research has been conducted to examine individual variation in the learning, beliefs, practices, and subjective experiences of compassion meditation. This mixed-method study examines changes in novice meditators’ knowledge and contemplative experiences before, during, and after taking an intensive course in CBCT®, a contemplative intervention that is increasingly (...) used for both inter- and intrapersonal flourishing. The participants in this study were Christian healthcare chaplains completing a 1-year residency in Clinical Pastoral Education who learned CBCT as part of their professional chaplaincy training curriculum. Prior to and upon completion of training, we surveyed participants to assess their beliefs about the malleability of compassion, types of engagement in compassion meditation, and perceptions of the impact of taking CBCT. We also conducted in-depth interviews with a subset of participants to gain a qualitative understanding of their subjective experiences of learning and practicing compassion meditation, a key component of CBCT. We found that participants reported increases in the extent to which they believed compassion to be malleable after studying CBCT. We also found high levels of variability of individual ways of practicing and considered the implications of this for the study of contemplative learning processes. This multi-methodological approach yielded novel insights into how compassion practice and compassion-related outcomes interrelate, insights that can inform the basic scientific understanding of the experience of learning and enacting compassion meditation as a means of strengthening compassion itself. Interpreting Figurative Meaning critically evaluates the recent empirical work from psycholinguistics and neuroscience examining the successes and difficulties associated with interpreting figurative language. There is now a huge, often contradictory literature on how people understand figures of speech. Gibbs and Colston argue that there may not be a single theory or model that adequately explains both the processes and products of figurative meaning experience. Experimental research may ultimately be unable to simply adjudicate between current models in psychology, linguistics and philosophy (...) of how figurative meaning is interpreted. Alternatively, the authors advance a broad theoretical framework, motivated by ideas from 'dynamical systems theory', that describes the multiple, interacting influences which shape people's experiences of figurative meaning in discourse. This book details past research and theory, offers a critical assessment of this work and sets the stage for a new vision of figurative experience in human life. (shrink)

The US neutrino community gathered at the Workshop on the Intermediate Neutrino Program at Brookhaven National Laboratory February 4-6, 2015 to explore opportunities in neutrino physics over the next five to ten years. Scientists from particle, astroparticle and nuclear physics participated in the workshop. The workshop examined promising opportunities for neutrino physics in the intermediate term, including possible new small to mid-scale experiments, US contributions to large experiments, upgrades to existing experiments, R&D plans and theory. The workshop was organized into (...) two sets of parallel working group sessions, divided by physics topics and technology. Physics working groups covered topics on Sterile Neutrinos, Neutrino Mixing, Neutrino Interactions, Neutrino Properties and Astrophysical Neutrinos. Technology sessions were organized into Theory, Short-Baseline Accelerator Neutrinos, Reactor Neutrinos, Detector R&D and Source, Cyclotron and Meson Decay at Rest sessions.This report summarizes discussion and conclusions from the workshop. Much critical attention to the Dialectic of the Critique of Pure Reason is devoted to two related concerns. The first is Kant's skeptical attack on the claims of pure reason to epistemic authority, where the focus is on the paralogisms and the antinomies of pure reason. The second involves Kant's refutation of idealism. These two concerns are of course intimately connected with one another and there are various ways to express that interconnection. Perhaps most generally it can be said that (...) Kant's assessment of reason in these two contexts is negative: it argues for the limitation of reason's claim to unbridled application and views reason as a faculty whose native propensity to seek such employment must be checked. Reason, as it turns out, is the great metaphysical impostor, whose representations, the ideas, have no epistemic warrant whatsoever. For it is the essence of Kant's position in the Dialectic that metaphysical conundra cannot be solved so long as reason arrogates to itself a direct and unrestricted epistemic or cognitive role and that reason ought to forebear from assigning itself any such status. Such a self-restriction of reason is, additionally, transcendentally necessary because it is that very limitation, Kant argues, that constitutes transcendental critique. (shrink)

PLATO’S Protagoras is composed of three distinct frames. The outer frame consists in Socrates’ brief discussion with an unnamed companion. The remainder of the Protagoras is willingly narrated by Socrates to the companion, from memory of course, and apparently right after the main action. The inner frame consists in Socrates’ dialogue with Hippocrates. Roused before dawn by the impetuous young man, Socrates leads Hippocrates to reflect on the wisdom of his enthusiastic desire to study with Protagoras. This is a classic (...) and successful little example of Socratic dialogue. He then takes Hippocrates to meet Protagoras; the bulk of the dialogue—call it the innermost frame—consists in Socrates’ exchanges with Protagoras. Hippocrates does not utter a word in this part of the dialogue, though it is initiated at his request and seems undertaken by Socrates for his benefit. (shrink)

This Article examines the influence of the Americans with Disabilities Act (ADA) on affective attitudes toward children with disabilities and on the incidence of disability-selective abortion. Applying regression analysis to U.S. natality data, we find that the birthrate of children with Down syndrome declined significantly in the years following the ADA's passage. Controlling for technological, demographic, and cultural variables suggests that the ADA may have encouraged prospective parents to prevent the existence of the very class of people the Act was (...) designed to protect. We explain this paradox by showing how specific ADA provisions could have given rise to demeaning media depictions and social conditions that reinforced negative understandings and expectations among prospective parents about what it means to have a child with a disability. We discuss implications for reproduction law and antidiscrimination policy. (shrink)

Upshot: What von Foerster accomplished in raising the specter of second-order cybernetics now requires experimental design and the heavy lifting of theory to complete his quest for new ways of thinking. Scholte’s “black box theatre” points to research into non-trivial systems as a formal means of grasping living systems.

Emotional memories are vivid and lasting but not necessarily accurate. Under some conditions, emotion even increases people’s susceptibility to false memories. This review addresses when and why emotion leaves people vulnerable to misremembering events. Recent research suggests that pregoal emotions—those experienced before goal attainment or failure —narrow the scope of people’s attention to information that is central to their goals. This narrow focus can impair memory for peripheral details, leaving people vulnerable to misinformation concerning those details. In contrast, postgoal emotions—those (...) experienced after goal attainment or failure —broaden the scope of attention leaving people more resistant to misinformation. Implications for legal contexts, such as emotion-related errors in eyewitness testimony, are discussed. (shrink)

This paper argues that the mode of statesmanship recommended in Utopia provides the framework for the Epigrams. While Utopia demonstrates the need for artful indirection by exposing the vices of a man too proud to adopt it, the Epigrams exhibit More's preparation for and practice of a tactfully philosophic statesmanship.

The say-on-pay regulation in the Dodd-Frank Act requires publicly-traded U.S. firms to hold a nonbinding, advisory shareholder vote on executive compensation. Advocates claim that SOP voting gives shareholders a mechanism to hold managers and boards more accountable. Critics contend that SOP votes may simplistically reflect shareholders’ reactions to the overall value of CEO compensation or the firm’s net income. However, based on prior research, we contend that market participants’ SOP votes are likely to consider current income attributes. For example, the (...) market punishes firms that do not meet or beat benchmarks such as analyst earnings expectations, and that shareholders scrutinize the quality of the income sources of firms that consistently meet/beat analyst expectations. We thus expect that more shareholders will provide ‘agree’ SOP votes for a firm that consistently meets/beats analyst forecasts and does so when net income does not include nonrecurring gains. Further, we consider whether perceptions about the fairness of CEO compensation play a mediating role in the relationship between the interaction of these two current income attributes and SOP votes. Results from an experiment using evening MBA students as participants indicates that the two current income attributes significantly interact with respect to the percentage of agree SOP votes, and that compensation fairness perceptions fully mediate this relationship. Further, the mediating effect of compensation fairness perceptions is robust to including CEO-level and other determinants found in prior research. We conclude with a discussion of our findings and their implications for public policy and research. (shrink)

“Every step and every movement of the multitude, even in what are termed enlightened ages, are made with equal blindness to the future; and nations stumble upon establishments, which are indeed the result of human action, but not the execution of any human design.”—_Adam Ferguson_ During the Scottish Enlightenment, David Hume, Adam Smith, Adam Ferguson, and other lesser thinkers described a theory of spontaneously generated social order. Ronald Hamowy discusses their contributions to this significant area of social theory, noting that (...) the revolutionary aspect of these philosophers’ thoughts was “the proposition that social phenomena of a high degree of intricacy are not the product of intentional design.” Hamowy shows that Hume is best known for his application of the theory to justice, developing it most thoroughly in the _Treatise of Human Nature. _Adam Smith’s first treatment of it is in the _Theory of Moral Sentiment, _published before the significant _Wealth of Nations. _There Smith uses it to explain the development of general rules that compose the moral fabric of societies. All of these thinkers used their notion of spontaneously generated social order to explain systems of moral rules and social systems. In addition Adam Ferguson and David Hume applied the theory to language, as well as to economic development. (shrink)

Recently, a number of philosophers of biology have endorsed views about random drift that, we will argue, rest on an implicit assumption that the meaning of concepts such as drift can be understood through an examination of the mathematical models in which drift appears. They also seem to implicitly assume that ontological questions about the causality of terms appearing in the models can be gleaned from the models alone. We will question these general assumptions by showing how the same equation (...) — the simple 2 = p2 + 2pq + q2 — can be given radically different interpretations, one of which is a physical, causal process and one of which is not. This shows that mathematical models on their own yield neither interpretations nor ontological conclusions. Instead, we argue that these issues can only be resolved by considering the phenomena that the models were originally designed to represent and the phenomena to which the models are currently applied. When one does take those factors into account, starting with the motivation for Sewall Wright’s and R.A. Fisher’s early drift models and ending with contemporary applications, a very different picture of the concept of drift emerges. On this view, drift is a term for a set of physical processes, namely, indiscriminate sampling processes. (shrink)

Fichte was at the height of his philosophical activity and influence during the last decade of the eighteenth century in Jena. It was during this period that he developed his idea of a Wissenschaftslehre or a “science of knowledge.” A Wissenschaftslehre is an ongoing investigation by subjects of their subjectivity which may be captured only imperfectly in medias res in the form of a written document, but which is crucially not identical with any written philosophical text. So Fichte distinguishes between (...) Wissenschaftslehre and its presentations. In the Jena period Fichte completed two such presentations. The first, the Grundlage der gesammten Wis-senschaftslehre [WL], contains the famous analysis of the preconditions for consciousness in terms of the posits of I and not-I and their reciprocal limitation. Fichte became dissatisfied with his treatment of the central problems in the 1794 version and began working on a second version in 1796. Only two introductions and the first chapter of this new presentation appeared in print. Due to his dawning belief that philosophy was appropriately done solely in oral or dialogic form and the psychic toll of the “atheism controversy” that led to his dismissal from Jena in 1799, by the early 1800's Fichte abandoned plans to publish the entire second presentation. Lectures on the entire second presentation given in 1796-9, the Wissenschaftslehre nova methodo [WLnm], are preserved, however, in two sets of student notes. The importance of the discovery of these notes is difficult to overestimate. WLnm develops new and more convincing positions on such fundamental issues as the nature of subjectivity, the unity of reason, and the relation between self-consciousness and intersubjectivity that greatly enhance Fichte's historical status and his relevance to contemporary debates on a variety of philosophical concerns. Listening represents a welcome contribution to the now substantial body of recent literature on Phaedrus. In the book's seven chapters, Ferrari discusses various parts of the dialogue and offers many helpful points along the way. For example, Ferrari's remarks are good on the controverted question as to whether the lover in the palinode "uses" the beloved, as are his observations about the struggle between the three parts of the soul. Ferrari persuasively points out that each part of the soul really (...) represents a way of life, a possible human type. Ferrari offers the novel and probably correct view that the question as to the authenticity of the speech attributed to Lysias is intended ironically by Plato to parallel the question as to whether the "demythologizers" are right to pursue the historical origins of myths. In his last chapter Ferrari surveys various approaches to the famous critique of writing, opting for a modified version of the view that the critique is meant to express a serious distrust of writing, that Plato thought he had discovered a way of writing that avoided the thrust of critique, and that the spoken word ultimately remains superior. Ferrari thus positions himself against Burger's and Derrida's interpretations. Ferrari rightly sees that the critique of writing engages the major issues of the dialogue and ought not be severed from them. (shrink)

In book Ten of the Laws, Plato's Athenian Stranger sets out the out lines of an argument of the sort that effectively dominated thinking for several millennia about the political role of religion. A polis that is to be free from faction and free for the right development of character requires a shared understanding of the human good and of the virtues of soul that are its components; religion provides that understanding in a way that connects up the human good (...) with the nature of the whole; as the function of government is to support civic peace and a flourishing citizenry, it must support the means thereto, namely, a civic religion; and effective support, in turn, requires state-enforced prohibitions against publicly expressed disavowals or corruptions of that dogma. Not just any dogma will do, of course, and the Stranger devotes a good deal of energy to setting out the principles of the new religion. (shrink)
